The Bankruptcy Process

The first step in the bankruptcy process is filing for bankruptcy. This step is not as easy as it sounds, as it generally involves preparing a petition detailing assets, income, expenses, and debt owed to all creditors, and other financial information, properly filling out all necessary forms, and then filing in bankruptcy court.

Upon filing, the court grants an automatic stay that prohibits creditors from any contact regarding payment collection, or from freezing bank accounts, garnishing wages, or filing or continuing a lawsuit or foreclosure action. From there, the process varies depending on the type of bankruptcy filed.
