The Bankruptcy Process

Filing for bankruptcy generally involves preparing a petition detailing assets, income, expenses, and debt owed to all creditors, and other financial information, and filing in bankruptcy court. Upon filing, the court grants an automatic stay that prohibits creditors from any contact regarding payment collection, or from freezing bank accounts, garnishing wages, or filing or continuing a lawsuit or foreclosure action. The process varies depending on the type of bankruptcy filed.

Our skilled bankruptcy attorneys are prepared to handle the complete bankruptcy process involving:

  • Chapter 7 - This personal and business form of bankruptcy will result in liquidation of nonexempt assets, and the discharge of qualifying debt with no further collection allowed. A bankruptcy court trustee is assigned to evaluate and sell nonexempt assets, with proceeds used to pay specified creditors.
  • Chapter 13 - This personal reorganization form of bankruptcy allows debtors to repay some or all debt to creditors over time, through a court-approved payment plan.
From understanding the bankruptcy process to accurately determining which form of bankruptcy you qualify for, and best meets your needs, we can help you protect your interests and secure your position in a bankruptcy case. Contact our Tarrytown, New York, or Mahwah, New Jersey, offices to lean more.
