Protecting your rights in the workplace

When dealing with an employee’s rights in the workplace, an employee may feel like the underdog in a David versus Goliath battle. Often, with fewer financial resources at his or her disposal, collecting evidence and strengthening one’s side may seem like an uphill fight. But the fact is that all employees have very specific rights, and these rights are protected on both federal, state and local levels, including organizations such as the Occupational Safety and Health Administration or OSHA, the Fair Labor Standards Act and the Employee Retirement Income Security Act or ERISA, a federal law protected under the United States Department of Labor.

Such laws and acts are in place to assure that employees are working in an environment free of harassment and discrimination and that precautions have been put in place to assure workers’ safety. In addition, for workers who recognize illegal behavior by their employer, there are whistleblower protections in place to protect a worker from retaliation by his or her employer if the illegal activities are reported to authorities.
